Collaborator undertaking
Version v1.4 · sha256 a060c2248d16… · Approved on 6 October 2026
1. What you are and what you are not
You collaborate with RENTA100 SERVICIOS, S.L. by introducing to us people who may be interested in a transaction: owners who want to obtain liquidity from their home without ceasing to live in it, and investors. Your involvement ends when you introduce that person to us. We do everything else.
You are not an employee, an agent or a representative of ours, and you may not present yourself as one. You do not sign anything in our name, you do not accept mandates, you do not set prices or fees and you do not receive sums on our behalf.
You do not work on our behalf: you keep your own business, your own clients and your own organisation, and you decide when and how you work. You are not obliged to introduce anyone to us.
The email address of your collaborator account can only have that role on the platform: with it you cannot also be an investor or an owner.
2. How you present us: the Dossier and the Marketplace listings
To present RENTA100 and the four products you use the Dossier, the document that explains what RENTA100 is and how each product works. It is in your portal, with its version number and its date, and it is the only material of ours that you may use for that. You present specific transactions with the Marketplace listings, under the rules of section 9.
You show or hand over the Dossier exactly as we give it to you: without changing it, without cutting it, without adding figures or sentences to it and without mixing it with other materials. When we notify you of a new version, you withdraw the previous one, in any medium, within a maximum of five working days.
You do not hand over other documents of ours —we provide the pre-contractual information— nor collect documentation for us. For everything that goes beyond the Dossier and the listings, you refer the person to us. If you add explanations, figures or statements of your own, you are responsible for them.
3. What you may never say
- You do not give figures of your own, nor make calculations or simulations outside the platform. You may use the calculator of the Marketplace listings and show its result to a potential investor. If you repeat a figure from the Dossier or from the Marketplace, including the calculator's, you state it exactly as it appears and with its literal notice: «indicative · pending actuarial validation». No figure is a binding offer of ours: the only binding offer is the one an investor makes.
- You do not promise results, timescales, prices, income or returns, you do not present a transaction as if it carried no risk and you do not hide or play down the risks that the Dossier describes.
- You never say that payment is guaranteed or assured. It is not.
- You do not call the free valuation an «appraisal». It is an indicative valuation. The official appraisal is something else: it is carried out by an independent appraisal company before the signing.
- You do not explain taxation beyond what the Dossier says, and never that of a specific case. In particular, you do not state that a transaction is exempt from tax: exemptions have conditions, and the person who assesses them is the owner's tax adviser.
- You do not give legal, tax, financial or actuarial opinions in our name. If you give them in your own profession, you do so under your sole responsibility and without using our name, our brand or the Dossier.
- You do not say that we will provide a lawyer. We do not do so, we do not pay for one and we do not propose anyone.
- You do not state that a transaction has been approved before it has been.
4. With older people, in addition
Most of the owners we are interested in are over sixty-five. With them, in addition:
- you do not rush them, and you recommend that they consult their family and an independent legal adviser;
- if you perceive that the person is not understanding what is being explained to them, or that their decision is not free, you stop: you do not register them or give them your link.
5. How you register a person
Each person you introduce to us is registered as a referral. An owner can register themselves, with your link or your personal code, or you can register them from your portal, with their authorisation. An investor registers themselves, with your link, with your personal code or from the link to a listing that you have sent them.
You register, or give your link to, only someone who has asked you for RENTA100 to contact them, and you keep proof of that request. You do not use purchased or third-party contact lists, and you do not make commercial communications in our name.
Before collecting their data:
- you inform them of how it will be processed, with the information model of the Data protection agreement, you keep proof of having done so and you show it to us if we ask for it;
- you tell them that, if a transaction comes to be signed, RENTA100 will pay you a commission, and that this does not increase what they pay.
Of an owner you register only this: their first name and, if they provide them, their surnames; their telephone number and, if they have one, their email address; the municipality and the province of the home; the product or products they are interested in, if they already know; and, if you wish, practical notes for contacting them, such as the best time to call. In the notes you do not write health, marital or financial details, or any opinion about the person.
You do not communicate anything else to us —neither the age or the date of birth, nor the sex, nor other details of the home, nor financial details—, nor collect it for us. We ask the owner for that data directly, after validating the referral.
When registering an owner you confirm these two things, and you may only confirm them if they are true:
- «The owner has asked RENTA100 to contact them and has received the data protection information.»
- «The owner knows that I am acting as a collaborator and that RENTA100 will pay me a commission if a transaction is signed.»
The platform keeps the date of both confirmations.
You communicate the data to us only through the platform, or through the encrypted channel that we indicate to you: never by instant messaging, by unencrypted email or on paper. If the person tells you that they do not want us to contact them, or asks you to delete their data before you register them, you do not register them; and if you had already registered them, you ask us to withdraw the referral.
You remain responsible for the data of your own clients, for your own business. From the moment we receive a referral, we are also responsible for the data you have communicated to us, for our own purposes.
6. What happens next
We validate referrals in order of arrival, each one within a maximum of ten working days from when we receive it. We check that the person was not already on the platform, that the information is complete and that they confirm that you are involved. We tell you through the platform whether we validate it or, if not, why.
A person is already on the platform if, when we received their referral, we had our own record of them with a contact in the previous twelve months —a contact request, a simulation with contact details that we still keep or a transaction— or a referral from another collaborator already validated and in force. The notification list for the opening of the platform does not count.
If two collaborators introduce the same person, the referral we validate first counts. And if a transaction has several owners or several investors, only one referral per party gives rise to a commission: the one we validate first. We do not share commissions between collaborators.
A validated referral, of an owner or of an investor, does not expire: it remains in force for as long as your collaboration agreement lasts and ends with it. When a referral ends, another collaborator may introduce that same person.
From the moment you introduce someone to us, we take care of everything: the contact, the information, the contracts, the valuation, the visits, the proposals, the appraisal, the arras and the preparation of the signing before a notary. You do not negotiate, you do not accompany visits, you do not pass on proposals, you do not collect documentation and you do not take part in the signing, unless we ask you to in writing. In your portal you can follow what stage each referral is at. We do not tell you the content of the negotiations or details of the other party.
Of the investors you introduced to us you also see which transactions they have shown interest in, sent an offer for, have under way or have signed, and what stage each one is at. You do not see the amount or the content of the offers, the documents of the transaction or anything about the identity and source-of-funds checks. You only see this for the investors to whom we have explained it when they registered, and you stop seeing it if the investor asks us to. This does not change your referral or your commission.
A validated referral does not give you any right against the owner or the investor, or a right to a commission if the transaction is not signed. And you do not take part, either directly or through others, in a transaction that people who met through RENTA100 want to close without us. If you know of an attempt to do so, you tell us.
7. The money does not pass through you
You do not receive anything from the owner or from the investor, neither in advance, nor on account, nor as expenses, neither in money nor in kind. Nor do you collect money or documents for us: neither deposits, nor identity documents, nor supporting documents.
It is we who identify owners and investors and, when the law requires it, examine the source of the funds. If you see signs that someone is acting on behalf of another person who does not identify themselves, that they are offering funds whose source they cannot justify or that they want to avoid the identification checks, you tell us as soon as you know, and you do not warn that person.
8. Your commission
Your only remuneration is the commission that we pay you. It is always on success: it only accrues if the transaction is signed before a notary and we collect the fees that accrue on that signing.
- For the transaction signed by an owner you introduced to us: 1% of the value of the official appraisal.
- For each transaction signed by an investor you introduced to us, while your referral is in force: 1%.
- If you introduced both parties to the same transaction: 2%.
For the people introduced to us, a transaction never pays more than 2% among all the collaborators, and you do not receive more than 2% for the same transaction. If your agreement allows you to introduce other collaborators, the introduction commission of section 10, of 0.1%, is separate: with it, you never receive more than 2.1% for the same transaction.
The commission is fixed on the day of the signing, in accordance with the agreement in force that day. There is no commission for transactions signed when your referral has already ended —except for what section 14 says for when the collaboration ends—, nor if you received anything from the owner or from the investor.
We notify you of each commission through the platform, you issue your invoice to us within a maximum of ten working days and we pay it within the thirty calendar days following the collection of our fees, or the receipt of your invoice if it arrives later. The full conditions, including those on repayment, are in your agreement.
9. The Marketplace
In your portal you have the same Marketplace that investors see, to find transactions that may interest investors in your circle. Each listing shows the same as an investor sees: photographs and characteristics of the home, municipality and province, product, price or initial payment and income, the age in years and the sex of each usufructuary and an indicative return, with the listing's calculator. It does not show documents, or the name, the address, the marital status, the health, the individual life expectancy or the date or the year of birth of anyone. Each screen carries your personal code, and the transactions of the owners you introduced to us do not appear in your Marketplace.
With those listings:
- you may show a listing in person to a potential investor, on the screen of your own device, and comment on what it shows, under the rules of section 3, in private; never in advertising, on social media or in mass mailings;
- if you want a potential investor to see it without you being present, you only send them the link to that listing created by the platform, addressed to that person, and you do not publish it on websites, social media, portals or mass mailings;
- you do not capture, download, photograph, print, copy or forward listings, either in whole or in part, nor communicate them by any other means;
- you do not try to find out who the owner of a listing is, nor communicate anything that would make it possible to identify them.
Anyone who opens the link without being registered sees the listing without the calculator and without documents, with the sentence from section 13 that says that you are an independent collaborator. To use the calculator, show interest or make an offer they have to register; if they do so from that link, with your code, their registration is an investor referral of yours, which we validate like the others. You may only send listings of transactions whose owner has authorised it, and the link stops working when the transaction stops being published, when your registration is suspended or your agreement ends, or when you or we revoke it.
What you view in the Marketplace, your use of the calculator and the links you create are recorded under your name for twelve months.
Your account is personal: you do not share your passwords with anyone.
10. Introducing other collaborators, if your agreement provides for it
If your collaboration agreement provides for it, you may give your link or your personal code to other professionals so that they apply to register as collaborators of RENTA100. If we approve the registration of the person who applied with your link or your code, you are their introducer. Then, for each transaction in which that collaborator receives a commission for the people they introduced to us, we pay you an introduction commission of 0.1% of the value of the official appraisal.
- We pay it, out of our fees. It does not reduce the commission of the introduced collaborator or increase what the owner or the investor pays.
- There is only one per transaction, even if two collaborators introduced by you receive a commission on it, or a single one does so for both parties.
- It is single-level: if the collaborator you introduced in turn introduces another collaborator, you receive nothing for that other one's transactions.
- It only accrues on signed transactions, if your agreement is still in force on the day of the signing, except for what section 14 says. It follows the fate of the commission of the collaborator you introduced: if they have to repay it, you also repay yours.
- We decide freely on each registration. Only someone who applies with your link or your code while your agreement is in force, and who is not and has not been a collaborator of ours, counts. Each collaborator has only one introducer, and this cannot be changed.
In return:
- you do not act as your own introducer, nor through a company that you control or manage, nor through another person;
- you do not charge the person you introduce anything, in money or in kind, for introducing them or for their registration, and you do not ask them for purchases, fees or the contracting of services;
- you do not offer introducing as a way of earning money by recruiting collaborators, nor promise income to the person you introduce;
- before giving them your link or your code, you tell them that, if we approve their registration, you will be paid by RENTA100 0.1% of the transactions in which they receive a commission, and that this does not reduce theirs;
- you do not direct, train, supervise or represent the collaborators you introduced: each one has their own agreement with us, and you are not responsible for what they do.
Of the collaborators you introduced you see the name under which they applied, the date of the application and its status: under review, approved, not approved or no longer active. We do not tell you why we decide what we decide, nor their referrals, their clients or their commissions; only what is necessary to pay you: for each transaction that generates an introduction commission for you, which one it is, the signing date, the value of the official appraisal and the amount. If another collaborator introduced you, they see the same about you.
If your agreement does not provide for introducing other collaborators, you cannot introduce them: anyone who applies with your link or your code will have no introducer, you receive nothing for it, and you do not charge anyone anything for helping them register, nor offer it as a way of earning money.
11. Confidentiality and personal data
Everything you see on the platform, or know through this collaboration, that is not public is confidential: data of owners and of investors, the content of the Marketplace, figures of transactions, commissions, what the investors you introduced to us do, what you know about the collaborators you introduced, and our tools and the way they calculate. You do not use it for anything other than this collaboration nor communicate it to anyone.
You continue to process the data you already had about your clients for your own business, but while the referral of a person is in force you do not transfer it to third parties for transactions like ours. What you see on the platform and have not collected yourself, you do not incorporate into your own files. And you never give an investor, or anyone who receives a link from you, more data about an owner than the listing shows.
If someone makes a request to you to exercise their rights and the request affects what we do, you pass it on to us within a maximum of two working days. If you suspect that someone has entered your account or has seen data that they should not have, you notify us within a maximum of twenty-four hours.
The confidentiality obligation lasts five years after the collaboration ends and, for personal data and our business secrets, without time limit.
12. Your registration, your insurance and complaints
You declare that you meet the requirements that your activity calls for in your autonomous region —registration in the relevant register and compulsory insurance— and you undertake to tell us if you stop meeting them. You also comply with the regulations that apply to your own business, including those on data protection, on consumers and, if you are obliged, on the prevention of money laundering.
We do not cover you: your professional liability is your own.
If an owner, an investor or an authority sends you a complaint, a claim or a formal demand relating to RENTA100, you tell us within a maximum of two working days.
13. Our brand and the Badge
You may identify yourself as «RENTA100 authorised collaborator», next to your own brand or name and never in a larger size than them, with the logo and the Badge exactly as we give them to you. The Badge carries a QR code that checks, at the moment it is consulted, whether your registration is still in force, and the statement «does not evidence training or level». You do not present it as anything else.
All your advertising that mentions RENTA100 includes this sentence, which also accompanies the listings that you send: «[Your name] is an independent collaborator. RENTA100 SERVICIOS, S.L. is the agency that intermediates in the transactions.»
You do not modify the logo; you do not combine our brand with yours in a way that looks like a joint brand, a franchise or a company; you do not register it or use it in domains, social media profiles, trade names or company names; and you do not use it in advertising with figures that do not come from the platform or that do not carry their notice, that promises results or that presents a transaction as if it carried no risk.
If your registration is suspended or the collaboration ends, you stop using the brand and the Badge immediately, and you remove them from all your media within a maximum of five working days from when we notify you. If the collaboration ends, you also stop using the Dossier, and you return or destroy the copies you have, as we indicate to you, and you confirm it to us in writing.
14. Duration, termination and applicable law
Your agreement lasts one year and renews automatically, year by year. Either you or we can end it at any time, giving thirty days' written notice.
If you commit a serious breach —for example, charging the owner or the investor, giving figures without their notice or as if they were an offer, misusing the Dossier or the brand, capturing, copying or forwarding Marketplace listings or sending them by any means other than your link, or acting as your own introducer or charging for introducing another—, we may suspend your registration, temporarily and proportionately, while we verify it, or terminate the agreement immediately. While your registration is suspended you cannot register referrals, enter the Marketplace, send listings or introduce collaborators, and your links stop working; you keep your accrued commissions and your validated referrals. If you breach another essential obligation and do not remedy it within fifteen days of our asking you in writing, we may also terminate it; and you can do the same if it is we who breach an essential obligation, for example if we do not pay you an accrued commission. Commissions already accrued are paid in any case.
When the agreement ends, your referrals end with it, and there is no commission for transactions signed afterwards. There is a single exception: if the agreement ends because we end it or do not renew it, or because you terminate it for a breach of ours, you receive the commission for each transaction that on that day was already under way —with an investor's proposal accepted in writing by the owner— and that comes from a referral of yours, if it comes to be signed. The same applies to the introduction commission. If the agreement ends because you end it or do not renew it, or because we terminate it for a breach of yours, there is no exception.
While the agreement lasts, you do not introduce owners to other companies or platforms that carry out transactions like ours. In the twelve months after it ends, you do not work for them in transactions like ours with the people or with the homes that have passed through our platform while your agreement lasted. You may continue doing any other intermediation, including ordinary sales and rentals. The details, including a penalty if you breach this, are in your agreement.
The applicable law and the competent courts are those set by your collaboration agreement.
15. This undertaking and your agreement
This undertaking summarises in plain words the main points of your collaboration agreement and of the data protection agreement that accompanies it. If anything that it says here does not match them, they prevail: on data protection, the data protection agreement; on everything else, the collaboration agreement.
When it changes, we will ask you to accept it again when you enter your portal.
